A divorce can have a crippling effect on a family. The situation can be even more difficult if there are children involved. Emotions run high and, typically, both parents want to have legal custody. Hence, in the best interest of the child, courts often grant legal custody to both parents. That means that while the child still lives with one parent, both parents make decisions regarding education and health care coverage as well as other important matters together.
California courts expect the child custody arrangement to be respected. However, sometimes, parents may ignore the rules and violate the court order. Take, for example, the case of a mother who ran away with her daughter because the woman allegedly does not want the child to be in touch with the father. The child's father feels that the woman might have fled to another state with her daughter and with her new husband.
An arrest warrant has been issued in the mother's name and authorities intend to charge her with three felonies. The charges against her include leaving the state after her ex-spouse wanted shared legal custody. The nine-year old daughter has stopped attending school. On the day that the woman and her daughter disappeared, the woman's new husband also quit his job.
There is a criminal complaint against the woman because she did not allow genetic testing of her new husband after telling the court that the man may be the girl's father. The woman has also severed all communication with her own mother. According to records, the California courts granted child custody to the man because she violated the California court order.
Child custody cases like this one can become complicated so it may be a good idea to consult a California attorney for advice and guidance.
